A Message From Our CDSOC President

As most of you are now aware, the Orange County Superior Court, including all family law departments have been closed since approximately March 17, 2020. The Presiding Judge for Family Law, the Honorable Lon Hurwitz, recently issued a rather chilling summary of the state of affairs with our local family law court, resulting from the court closure due to COVID-19. We shared some of Judge Hurwitz’s remarks and statistics with those of you who attended our virtual ZOOM “luncheon” on April 16, 2020.

As of April 13, 2020:

  • Over 10,000 previously-scheduled hearings have been trailed or continued;
  • There are 1,585 Judgments pending processing;
  • There are 200 Minute Orders awaiting completion;
  • There are 178 Orders pending processing in the Courtrooms; and
  • There are 7,360 documents waiting in the “queue” for filing. This does not include Domestic Violence filings or Judgments.

In addition to citing these statistics, Judge Hurwitz made the following perceptive comments:

“As a result of all of the above, all of you, and your clients should seriously consider what the future might look like in terms of their ability to obtain an expeditious resolution of any non-emergent matter. While none of us can predict when we will re-open, or what things will look like when we re-open, I believe the evidence of what is to come is so overwhelming that to reject any attempt at resolving your cases now may prove to be a serious mistake in the future.”

These challenging times present us with a unique opportunity to offer our services to our litigation colleagues whose cases are not going to be moving through the court system any time soon, based on Judge Hurwitz’s troubling assessment.  Online platforms such as ZOOM and Webex are proving reliable options in both collaborative and mediation settings. What better time for family law litigants to utilize the assistance of our trained professionals to help them to competently and expeditiously resolve their family law matters? It appears to me that our commitment to assist clients to resolve their conflicts through a consensual, non-adversarial process is needed now more than ever.

To our Members,

I know that we all miss meeting in person for our monthly luncheon on the third Thursday of each month. In the meantime, your Board is working hard to fashion creative ways for us to come together virtually for various programs, like the ZOOM “luncheon” we held earlier this month.  We are also now offering our popular Divorce Options program, online, currently at no charge to the attendees.  Please stay tuned to this space in the coming days for these exciting developments as we continue to work to provide relevant content to our Members during this time of mandated physical distancing.

Times that are requiring us to stay physically apart from one another, just at a time when we need each other more than ever. Our experienced collaborative lawyers, mental health professionals and financial experts are trained to assist you in resolving your family law matter without the need to ever go to court. Our trained professionals can help parties to fashion creative solutions during divorce that often lead to far better outcomes for families, both emotionally and financially, making it a preferred option for resolution.

Now that our Orange County courts are closed for the foreseeable future, what better time to utilize the assistance of our trained professionals to help resolve your family law matters?  Our professionals are able to use a variety of online tools to hold meetings, collaborative sessions, mediations and settlement negotiations, and at the same time, maintain the requirements of social distancing.
